|style="font-size:1.1em;"| Palaver-settling is a pidgin term used colloquially in West and Central Africa to describe a local dispute, disagreement, or community-level commotion. It is typically settled in a village's palaver hut, a physical structure dedicated to facilitating the non-violent resolution of disputes.

The etymology of palaver can be traced to the late fifteenth century. The term derives from the Portuguese palavra, meaning "word or speech" (Shumway 2021). Palavra was used in trade negotiations between Portuguese sailors and African coastal communities, and the term was subsequently adopted by communities in coastal West Africa that used pidgin and creole languages during these negotiations. As the word entered local linguistic tradition, it took on a narrower meaning, connoting "contentious discussion" (Ogunsanwo 2006). Over time, palaver became associated specifically with disputes that demanded collective resolution, such as marital conflicts, land disputes, debt issues, and minor criminal matters.

This type of informal dispute settlement has been documented across many regions of West and Central Africa. Palavers are typically settled in a village's palaver hut (Allouche and Jackson 2018), a structure dedicated to resolving disputes without violence. The appearance of these structures varies by region. In Mali, palaver settlements take place in a togu na, which typically stands about five and a half feet tall, requiring men to sit while inside (The Art Institute of Chicago, n.d.). The low roof is intended to reduce the likelihood of violence as discussions intensify. In other West African communities, such as in Liberia, palaver huts are circular and built from natural materials such as wood, mud, and clay, with thatched roofs. This circular space is designed to create a sense of equality among participants (Sy 2017), forming a non-hierarchical setting that favours dialogue over confrontation and supports reconciliation.

Within the traditional palaver hut system, each party is first given the opportunity to state their grievance and defence before the local chief, who then facilitates an agreement that both parties consider fair, bringing the dispute to an end (UN Women 2012). Cleansing rituals then take place to complete the process (Huyse 2008). A community member who fails to adhere to this system may face repercussions, such as community-imposed penalties, exclusion from positions of public responsibility, or legal action under criminal or civil law. The system therefore allows most disputes to be resolved without state intervention. An oral record of settled palavers is kept and passed down through generations, meaning that the outcomes of previous palavers "can, to a degree, be considered law" (Monrad 2009). This informal method of justice plays a central role in maintaining social harmony in many West and Central African communities by resolving disputes at the community level rather than escalating them to higher judicial authorities.

The system, however, remains susceptible to corruption. One contributing factor is the "lack of coordination between the formal law and customary legal systems, which consequently impedes fair execution of justice" (McKenzie et al. 2009). This disconnect creates an opportunity for those mediating the palaver to shape outcomes in ways that reflect personal interests or reinforce existing social hierarchies rather than upholding impartial justice. Chiefs receive a state salary in compensation for duties such as supporting rural development through cooperation with governmental and non-governmental organisations, arranging tribal ceremonies, and acting as spokesperson for their community (Sharma 2011). However, the International Crisis Group found that the scarcity of state-provided compensation has on occasion led chiefs to impose unwarranted fines to generate income (McKenzie et al. 2009). Because men most commonly occupy executive positions within the palaver hut system, women may be more vulnerable to discriminatory arbitration (McKenzie et al. 2009). It is nonetheless worth noting that, in most West African communities, the right to appeal a verdict to the village or chief has generally been respected (Shumway 2021).

Palaver-settling operates within a context of legal plurality, where the state formally monopolises criminal jurisdiction, yet everyday justice is frequently delivered through local mediation in the palaver system. This local dispute settling relies on community-based procedures, verbal argument, and social sanction rather than the state's formal courts. The palaver hut system does not typically receive detailed written legal codification; instead, it is codified through oral precedent and ritual, alongside statutory recognition of customary law and local courts.

Beyond palaver-settling, a range of other informal dispute-resolution practices operate across different cultural contexts. Aqsaqals play a crucial role in informal governance in Central Asia (see Aqsaqal (Kazakhstan, Kyrgyzstan, and Uzbekistan)). Aqsaqals are "old male members [of the community] sitting in the [Council of elders], tasked with mediating and resolving local disputes" (Tokyzhanova 2022), drawing their seniority both from old age as "an indication of divine favour" and from their standing as "custodians of knowledge and wisdom" (Wasosa 2025). Although the two practices differ functionally and geographically, both rely on respected elders, whether aqsaqals or chiefs, to guide community members, with the shared aim of maintaining social harmony through reconciliation rather than punishment. A key difference lies in the venue of mediation: aqsaqals take a more private, advisory role, whereas chiefs settling palaver operate in a communal setting.

The informal governance practices of Jirga / Shura councils in Afghanistan follow a similar pattern (see Jirga / Shura (Afghanistan)). Described as "a gathering of elders for resolving local or national conflicts" (Nosworthy 2020), these councils likewise operate at the local level and prioritise the authority of respected community leaders. Meetings are "highly ritualised" (Nosworthy 2020) and rooted in Islamic tradition, with disputes resolved through consensus or majority vote, and the resulting decisions "binding for all parties involved" (Nosworthy 2020). While all three systems spotlight the authority of elders, they differ in their degree of public participation and the coercive weight of their decisions. This weight varies according to how compliance is achieved: aqsaqals rely primarily on moral authority and social respect, making their rulings persuasive rather than binding; chiefs benefit from communal visibility, where public participation intensifies social pressure and reinforces compliance; and Jirga / Shura councils carry the greatest coercive force, since their decisions are considered binding and can be enforced through structured sanctions drawing on customary and religious authority. Considered together, these practices show how diverse societies have developed culturally specific but functionally comparable systems of informal governance that supplement formal state institutions.
